TERMS & CONDITIONS

This agreement contains the terms and conditions of the agency, Qamber Designs and Media W.L.L. 

 

SECTION A. - COPYRIGHT

 

SECTION A.1. - RIGHTS TO THE AGENCY, QAMBER DESIGNS & MEDIA

 

All designs/artwork by Qamber Designs & Media is copyrighted. Qamber Designs & Media reserves full copyright over all versions of the design and is allowed to display and exhibit the design for promotional purposes of the Company. Copyright transfers can be arranged for a fee upon client request. 

Qamber Designs & Media has the right to reuse the fonts, textures, actions, and stock images previously used in other designs after repurchasing necessary licenses to reuse unless it is an exclusive image, however under no circumstances will a specific design be reused. Each design is exclusive to the client.

All illustrators under the Company and the artwork created for our clients are also allowed to display or exhibit the design on their portfolio for promotional purposes even if the project has been canceled.

SECTION A.2. - RIGHTS TO THE CLIENT

​

The client is not permitted to use any design in any way if it has not been paid for in full. The client is only allowed to use the design for promotional purposes of their business, albums, and books as long as the design has been paid in full and is not directly tampered with. The client or other third parties are not permitted to claim the design as their own or resell the design without consent. 

The client is not permitted to use ebook covers designed by Qamber Designs & Media and have another entity design the print/spread unless written permission is given by the Company.

The client is not permitted to take the branding of Book One in a series designed by Qamber Designs & Media and have another entity continue the series copying said branding unless written permission is given by the Company. If in any case this is violated, legal action will be taken. 

 

SECTION B. - CONFIDENTIALITY

All client information and materials are considered confidential and will only be used by Qamber Designs & Media to provide a quote or to complete a project. Client and project information will only be shared with our partner illustrators and will not be shared with any third party unless otherwise requested by the client.

 

SECTION C. - LIABILITY

​

Qamber Designs & Media, its employees, affiliates and contractors  shall not be liable for any incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of business or reputation or loss of data in any way related to our services.

Qamber Designs and Media is not responsible for any claim, or loss based on errors or any other inaccuracies appearing on our site or in our clients’ written documents, such as printed versions of the design projects of any kind, including without limitation as a result of any breach of the terms and conditions of this agreement.

In the event that a claim may arise Qamber Designs & Media’s total liability for any claim arising from or related to our services shall be limited to the amount paid by the client for the services in question.

 

SECTION D. - QUOTE

Qamber Designs & Media has the right to change design prices of the initial quote depending on the progress and outcome of the project.

Clients will be notified of the revised prices prior to any additional and/or any variations in the work being conducted that may result in the change of the original quotation’s pricing.

Upon acceptance of quotation by client, we recommend that the client responds to Qamber Designs & Media within a period of 3 working days during the brainstorming session(s) and 5 working days after the draft/ preliminary designs have been sent for review to the client.

SECTION D.1 - PAYMENT METHOD

​

The client has to pay the full amount prior to receiving the final files. The client may pay via Cash, Cheque (If Bahrain-based), Paypal, Wire transfer, or Benefit Pay (If Bahrain-based).

     

SECTION E. - REFUND POLICY & CANCELLATION

​

All projects that are paid, at their beginning stages, halfway, or completed are non-refundable upon cancellation. The client may cancel a project at any time by providing a written notice. If the project is canceled by the client a cancellation fee will apply depending on the percentage of work completed for the project. 

 

SECTION F. - STOCK IMAGES & RESOURCES

​

All retail stock images and resources are included in the packages upto a limit of 25 USD unless otherwise stated. Any stock images and resources exceeding this limit will be charged accordingly along with transfer fees.

 

 

SECTION G. - DESIGN CHANGES

​

Each package has a limited number of changes that are stated in the package descriptions under services on https://www.qamberdesignsmedia.com/. If the cover exceeds the change limit, the project will automatically be upgraded to the next package or a separate additional charge will be applied. The extra charge depends on the complexity of the design change.

Additional charges will be included should the client require further changes after final approval and final files have been sent over.
 

SECTION H. - ACKNOWLEDGEMENTS

By hiring Qamber Designs & Media and using the final design, the client agrees to credit the company in the following ways; 

Cover art by Qamber Designs 

Interior formatting by Qamber Designs

Illustrated artwork by Qamber Designs 

Typography by Qamber Designs

Video by Qamber Designs

This may change depending on the illustrator and other affiliated members of our team.

 

SECTION J. -  SUSPENSION OF SERVICES

Qamber Designs & Media reserves the right to suspend/cancel any or all services or goods provided, if;

• The client has long overdue outstanding invoices

• You fail to comply with any provision of these terms and conditions or any other policy, directive, or requirement notified by Qamber Designs & Media W.L.L

 

SECTION K. -  GOVERNING LAW AND JURISDICTION

​

These terms and conditions shall be governed by and construed in accordance with the laws of the country where Qamber Designs & Media is registered.

Any disputes arising from or related to these terms and conditions or our services shall be subject to the exclusive jurisdiction of the courts of the country where Qamber Designs & Media is registered.

 

SECTION L. - CHANGES TO TERMS AND CONDITIONS

Qamber Designs & Media reserves the right to modify these terms and conditions at any time. Clients are responsible for reviewing the terms and conditions periodically to ensure that they are aware of any changes. By continuing to use our services after any changes to the terms and conditions have been posted, clients are deemed to have accepted those changes.

 

SECTION M. - ENTIRE AGREEMENT

These terms and conditions, together with any additional agreements or documents incorporated by reference, constitute the entire agreement between Qamber Designs & Media and the client with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral.
